Mirziyoyev called for promoting marriage contracts as a measure to protect families

During the meeting on mahalla issues, the President stated that in light of the increasing number of divorces and alimony issues, it is worth using marriage contracts more actively — they can protect families from financial difficulties and fairly distribute property when relationships break.

Why is this important

The institution of a marriage contract provides a legal mechanism for protecting the property rights of spouses. In a country where the number of divorces is increasing and there are cases of evasion of alimony obligations, promoting such contracts can increase the financial stability of families.

What happened

  • Since the beginning of the year, nearly 32,000 couples have divorced, and about 16,000 people are evading alimony payments.
  • The President noted the negative consequences of close relatives and early marriages, and called on young people to work on responsibility.
  • Among the proposals is the formalization of marriage contracts as a tool for resolving property issues in marriage and during divorce.
  • From December 1, 2025, the requirement for the original marriage contract is canceled — notaries will accept and work with electronic copies that are uploaded to the “Notarius” system.

What does law and practice say?

  • According to the Family Code, a marriage contract is an agreement between spouses that regulates their property rights and obligations in marriage and in the event of its dissolution.
  • The contract can be concluded before the marriage or during the marriage, but always in writing and with a notarized certificate.
  • Starting December 1st, notaries will no longer require original marriage contracts: simply uploading their copies to the “Notarius” system will be sufficient.
  • The law prohibits including provisions in the contract that worsen the position of one of the parties, or concerning personal relations or children’s rights — only property matters.

Context

The popularization of marriage contracts will require awareness-raising work at the mahalla level and among young people, especially in rural areas. The electrification of notarial services has already begun: the abolition of the requirement for originals is a step towards simplifying access to such contracts. In society, the task is to maintain a balance between protecting rights and preventing pressure on one of the parties to the contract.
