Why is this important
The used car market in Uzbekistan remains one of the largest segments of the consumer market, where buyers often face the risk of hidden mileage manipulation. The introduction of separate liability for concealing or failing to disclose changes to odometer readings is expected to strengthen consumer protection and increase transparency in vehicle sales transactions. At the same time, the amendments also affect the procedure for mitigating penalties imposed on drivers, making the process more formalized and dependent on a court decision.
What happened
- The Senate of the Oliy Majlis approved a law introducing amendments and additions to the Code of Administrative Responsibility.
- Under the document, administrative liability is being introduced for failing to notify a buyer that the odometer readings reflecting the vehicle’s mileage were changed or replaced. For this purpose, the Code of Administrative Responsibility is being supplemented with a new Article 178-2.
- In addition, the law changes the procedure for reducing the term of deprivation of the right to drive a vehicle or the right to hunt. From now on, decisions on mitigating such penalties will be made only by a court and only if the established conditions are met.
Numbers and facts
- Размер штрафа за сокрытие изменения пробега автомобиля составит от 10 до 15 БРВ. В денежном выражении сумма штрафа составит от 4,12 млн до 6,18 млн сумов.
- The new Article 178-2 specifically establishes liability for failing to inform the buyer about changes or replacement of a vehicle’s odometer readings.
- According to the new rules, reducing the term of deprivation of the right to drive or hunt will only be possible through a court decision.
- Mitigation measures will not apply to individuals who have previously benefited from such leniency or who committed repeated offenses during the punishment period.
- The draft law introducing liability for concealing mileage changes was approved by the Legislative Chamber of the Oliy Majlis in November last year.
Context
- For used car buyers, the new rules are expected to reduce the risk of purchasing vehicles with artificially reduced mileage and hidden wear.
- Sellers and intermediaries will now be required to disclose any interference with odometer readings; otherwise, they may face administrative fines.
- The new regulations also strengthen oversight of repeat offenses and limit opportunities for early mitigation of penalties for drivers.
- Such decisions will now be made only through judicial procedures and under clearly defined conditions.
- In addition, the law may increase transparency in the used car market, where accurate mileage information directly affects a vehicle’s value and technical assessment.
